The Paradox of Intellectual Property in Capitalism is an innovative book that comprehensively discusses and analyses intellectual property under capitalistic social conditions and relations. It not only addresses some historical developments of intellectual property but also brings to the fore the very notion of what knowledge is, knowledge creation, and knowledge production and appropriation within a Marxist framework. Nonetheless, the adopted approach pays heed to multiple fields of knowledge, providing rich discussions that facilitate the understanding of actual social totality in (...) which capitalism, knowledge production and appropriation, and the struggles of appropriation mutually reinforce each other, although not devoid of antagonisms and contradictions. In light of contemporary capitalism, the transformations that social property relations are undergoing must be scrutinised – such as those brought about by the development of digitalisation and the convergence between big pharma and tech giants. What are the conditions of intellectual property creation today? What theoretical assumptions does it make? Under what social relations is intellectual property produced? Throughout, the emphasis is not on individual cases or symptoms but on the overarching logic: the logic of capitalism as revealed in intellectual property. (shrink)

After the publication of Hart's Concept of Law, Dworkin published his article “The Model of Rules,” dividing positivism into two varieties: inclusive and exclusive. Many theorists involved in this debate have characterized Hart's position as inclusivist, which we reject in this article. We argue that Hart, in the postscript to The Concept of Law, conceded a point to Dworkin in accepting that inclusive positivism would imply the existence of objective moral standing, adopting a more “neutral” position—compatible with inclusive and exclusive (...) positivism—and consequently distancing himself from the incorporation thesis, which is paramount to inclusive positivism. The purpose of this study was to understand the perceptions of highly skilled and less skilled volleyball players about the influences that parents, coaches, and peers had on their sport development and performance achievement. Highly skilled (n= 30) and less skilled (n= 30) volleyball players participated in semi-structured retrospective interviews to explain how parents, coaches and peers may have influenced their sport participation. Data was analyzed through a process of content analysis. Results indicated that parents, coaches, and peers had an (...) important influence in player's sport development but differing according to players' expertise level. Concerning to parental influences, tangible support during the early years of development was mentioned by all players. However, parents' level of involvement and parenting styles revealed interesting differences between highly skilled and less skilled players. Highly skilled players perceived a moderate parental involvement and an autonomy-supportive parenting style, while less skilled players referred a excessive parental involvement in players' sport participation. Coaches influences showed to have some similarities in the early years with all players mentioning coaches as caring and recognizing their value as an athlete. However, highly skilled players described a different training environment characterized by a demanding coach, individualized instruction, and specific goal setting. Regarding peers' influence, all players recognized that friends were not only one of the main reasons to start playing volleyball, but also an important source of support to remain engaged and staying motivated to do sport. Highly skilled players, however, mentioned the importance of teammates' positive push and critiques during practice for enhancing their motivation, team cohesion and friendship. They also highlighted the importance of friends outside of sport in the later years of their career by acting as an escape from all the pressure that emerged from volleyball training and competition demands. Overall, these findings highlight different social influences according to the players' expertise level suggesting the need to examine more extensively the nature of significant others' support on athlete and talent development. American Trypanosomiasis, known as Chagas disease, was discovered in 1909 under peculiar circumstances: its discoverer, Carlos Chagas, was sent to a small village of Central Brazil to carry out an anti-malaria campaign when he came across a blood sucking insect—the vector for the parasite infection. He had been alerted to the coincidence of peculiar symptoms and the presence of this insect in the wood and earth dwellings of the region. He was deeply involved in theoretical controversies in international protozoology; he (...) was engaged in the consolidation of a scientific role and corresponding institutional conditions in Brazil, and equally immersed in the nationalist sanitary struggles of his days. In these contexts, Chagas assembled a remarkable discovery discourse, regarding the biology of the parasite, its life cycle and mode of transmission. Furthermore, he provided the clinical description of a new disease. Despite immediate international recognition, however, the unstable institutional arrangements surrounding his work damaged its local legitimacy for decades. We point out that current belief revision operations can be used to revise non-monotonic theories and we propose a new operation, called permissive belief revision. The underlying idea of permissive belief revision consists of instead of abandoning some beliefs during a revision, transforming those beliefs into weaker ones, while still keeping the resulting belief set consistent. This framework allows us to keep more beliefs than what is usual using existing belief base-based revision theories.

The Second Vatican Council was built within a solidly constituted tradition in the Catholic Church. All councils were held within the traditional and legal parameters of the Church. The question about the condition of possibility of a renewal Council under this tradition shows relevant. The Vatican II is the result of a negotiation between renewal and preservation. Pope John XXIII personally coordinated the construction of the legitimacy of the new event, following steps which may be rescued during the preparatory stages (...) of the great assembly. The reading of this process from sociological parameters may elucidate its plausibility within the tradition and the Church's bureaucratic organization. Pope John started ably a church renewal process, opening a new phase in the long Catholic tradition. O jornal Tribuna Criciumense foi o único impresso publicado na cidade de Criciúma no período deste escrito. Fundado em 1955, ele passou por três fases. Na primeira, produziu um discurso anticomunista, mas de maneira um pouco tímida. Na segunda fase, com curta duração, o impresso passou a valorizar a ideologia comunista e, ao mesmo tempo, a defesa do presidente João Goulart. A última fase foi marcada por ataques violentos contra o comunismo, em defesa do golpe civil-militar e da ditadura (...) implantada. Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. Mining text, however, is not aimed at replacing all subjective decisions that must be taken as part of literature review methodologies. (shrink)

Resumo: A percepção envolve muitos enigmas, nem sempre parecendo estar assegurada a unidade entre seu conteúdo e sua forma. Exemplificam tais enigmas as ilusões óticas, o célebre problema de Molyneux e também, como aqui nos interessa, o problema da expressão das cores em modelos cromáticos, que expressam incompatibilidades lógicas, mas se referem ao próprio território da experiência com cores e pigmentos. Neste nosso texto, distinguiremos dois usos do Farbenoktaeder por Wittgenstein, registrando a diferença, que julgamos relevante, entre a incompatibilidade ampla (...) e a incompatibilidade restrita entre cores. Tal examen está dividido en dos partes: en la primera parte cito y reflexiono en base a pasajes de la Crítica del juicio que sugieren que la belleza artística no es necesariamente una belleza adherente. En la segunda parte presento tres lecturas emprendidas (...) por intérpretes de Kant que proponen, las primeras, que la belleza artística puede ser de tipo libre, mientras la última, que la belleza artística, si es de arte bello, del arte del genio que se trata, es una belleza libre. O artigo tenta reconstruir alguns elementos acerca da passagem da Lógica da essência para a Lógica do conceito, da necessidade para a liberdade, na Ciência da Lógica hegeliana. No contexto da publicação dos duzentos anos dessa obra filosófica, a explicitação dessa passagem é referencial para a compreensão da Ciência da Lógica e de todo o pensamento hegeliano. O artigo procura sustentar que o binômio necessidade/contingência, um dos pares categoriais da Lógica da essência, não é adequado para a articulação da filosofia (...) hegeliana. Como Hegel afirma reiteradas vezes, é preciso superar a dura necessidade para dar lugar à lógica da liberdade. Para a discussão da problemática, a confrontação entre algumas categorias da essência, tais como substancialidade, necessidade, contingência e causalidade, e algumas categorias do conceito, tais como universalidade, particularidade e singularidade é o foco da exposição. Dessa discussão brota a noção hegeliana de liberdade e a sua relação com o sistema. (shrink)

Este artigo interpreta a quarta conferência de uma série de seis pronunciadas por Foucault em Berkeley (Universidade da Califórnia) de outubro a novembro de 1983. A problemática da parrhesia retomada pelo filósofo francês do diálogo Laques, de Platão, suscita uma discussão sobre os sentidos de democracia, sistema político em baixa na Atenas do final do século V a.C. Articulando os discursos cômico e filosófico, evidenciam-se, ao mesmo tempo, a força e as lacunas do texto de Foucault. Se, por um lado, (...) o interesse foucaultiano pela verdade força um retorno ao “falar franco”, por outro, falta, nesta conferência, um olhar de conjunto mais amplo que dê conta da parrhesia como sintoma de uma falta e da decadência do espírito democrático ateniense nos termos propostos no Laques. This paper consists in an analysis of two explanatory models of human behaviour which play a prominent role in the contemporary literature on human action. The first model - the causalist - aims at explaining action in terms of causes and general laws. The second model - the intentionalist - explains human action in terms of intentions and practical syllogism. The difficulties of both models are presented and in the last part of the essay we propose one alternative model, based (...) on the notion of retroduction.O trabalho consiste numa análise de dois modelos explicativos do comportamento humano considerados fundamentais na literatura contemporânea sobre teoria da ação. The paper focuses in philosophical problems concerning the nature of intentionality and mental representation. The first part presents a historical outline of the problem and reviews some classical/contemporary writings on the question. The second part examines the so-called Chinese Room Argument formulated by J. Searle. The third part presents a few arguments aiming to show the inadequacy of the functionalist model for the design of robots. The conclusion points to some alternatives to the traditional functionalist model such as, for instance, (...) the connectionist model.O artigo aborda problemas filosóficos relativos à natureza da intencionalidade e da representação mental. A primeira parte apresenta um breve histórico dos problemas, percorrendo rapidamente alguns episódios da filosofia clássica e da filosofia contemporânea. A terceira parte desenvolve alguns argumentos visando mostrar a inadequação do modelo funcionalista de mente na construção de robots. Este artigo tenta mostrar que as paixões naturais não dão conta, por si sós, da passagem da natureza ao Estado, por mais que o medo seja importante no começo da sociedade. A soberania da reta-razão em Hobbes parece ser necessária à criação do Estado civil. A razão natural, mediante as leis de natureza, apenas proíbe a um homem destruir sua vida ou privar-se dos meios necessários para preservá-la. Só uma razão geométrica, reta, que calcula segundo regras razoáveis, pode operar a (...) saída do estado de solidão em que os homens naturais se encontram inicialmente. O equacionamento da paz e da segurança para a vida satisfeita de cada homem impõe o cálculo que cria a unidade das vontades individuais, isto é, a forma geométrica do Estado soberano. (shrink)

Chemical elements are the bricks with which Chemistry is build. Their names had a history, but part of it is forgotten or barely known. In this article the forgotten, no more used, never used, and alternatively used names and symbols of the elements are reviewed, bringing to us some surprises and deeper knowledge about the richness of Chemistry. It should be stressed that chemical elements are important not only for chemists but for all people dealing with science. As in any (...) other aspect of our lives, we tend to better understand something by knowing his history. Mitochondrial dysfunction has long been considered a key mechanism in the ageing process but surprisingly little attention has been paid to the impact of mitochondrial number or density within cells. Recent reports suggest a positive association between mitochondrial density, energy homeostasis and longevity. However, mitochondrial number also determines the number of sites generating reactive oxygen species (ROS) and we suggest that the links between mitochondrial density and ageing are more complex, potentially acting in both directions. The idea that increased density, (...) especially when combined with mitochondrial dysfunction, might accelerate ageing is supported by a negative correlation between mitochondrial density and maximum longevity in an interspecies comparison in mammals, and by evidence for an intimate interconnection between cellular ROS levels, mitochondrial density and cellular ageing. Recent data suggest that retrograde response, which activates mitochondrial biogenesis, accompanies cellular ageing processes. We hypothesise that increased mitochondrial biogenesis, and possibly also impaired degradation and segregation of mitochondria, if occurring as adaptation to pre‐existing mitochondrial dysfunction, might aggravate ROS production and thus actively contribute to ageing. O texto é uma resenha da Doutrina do Conceito hegeliana recém editada e publicada em português. O terceiro livro da Ciência da Lógica é estruturado em subjetividade, objetividade e ideia, com cada uma destas partes também desenvolvida numa estrutura tripartite. Nesta exposição, merece destaque o movimento contraditório de autodeterminação do conceito, no qual a universalidade se autodiferencia imanentemente em particularidade e o conceito retorna a si mesmo na forma da universalidade concreta. O conceito passa pelas diferentes formas de mediação na (...) teoria do silogismo, especialmente com a mediação da universalidade, quando o conceito se transforma em objetividade. Esta começa com a relação externa do mecanismo, avança para a relação interna do quimismo e conclui na teleologia, onde a liberdade é mais elevada que a necessidade. A Ideia, última parte da Doutrina do Conceito, é a unidade sintética entre conceito e objetividade, com destaque no capítulo da Ideia absoluta na qual Hegel formula uma noção de método como estrutura e movimento do conteúdo e da racionalidade.
